
I am a Boundary & Neighbour Dispute Specialist based in Exeter and undertake work in the South West.
In my experience most surveyors and solicitors hate these disputes and are reluctant to become involved with them. Often the cost of litigating on such a dispute is out of proportion to the value of the land involved. Often, one or other of the parties or indeed both are fighting on a matter of principle which proves very expensive and so quite often the result is unsatisfactory to all parties.
During my career I have been instructed in numerous such disputes, many as a Single Joint Expert tasked with determining where a disputed boundary lies. I have given evidence in court in a number of these cases and in this way have gained useful insights into the way in which judges view such disputes as well as experiencing the reasoning behind their judgements.
I am always surprised at how many such disputes arise and, the motivation for the argument on the part of the two neighbours. I believe most professionals will try to dissuade people from litigating. Therefore, instructing a surveyor at an early stage can help put the risks and benefits of going to law into perspective.
